Terms of Service

This is an English convenience translation. In case of discrepancy, the French version (Conditions Générales de Vente) prevails, as it is governed by French law.
Askuria is currently in the rollout phase with a first set of selected clients and partners. These Terms of Service ("Terms") describe the general contractual framework applicable to Askuria's services. They are intended to be complemented or refined by a master agreement or a specific order form signed with each client, which prevails in case of conflict.
1. Purpose
These Terms govern the conditions under which ASKURIA ("Askuria", "we") makes its human-authority verification service available to its business clients ("the Client"), comprising a mobile application, a certificate and policy management infrastructure, and associated support services ("the Service").
2. Scope
Askuria is intended exclusively for business clients (companies, public bodies, associations) acting within their professional activity. These Terms do not apply to consumers within the meaning of consumer protection law.
3. Ordering and entry into force
Any provision of the Service is subject to a quote or specific contract specifying the scope (number of protected identities, activated modules, support level), duration, and financial terms. The Service is not currently offered as a self-service subscription; any order results from prior discussion with the Askuria team via the Contact page.
4. Pricing and billing
Applicable prices are those stated in the quote or contract accepted by the Client. Unless stated otherwise, they are expressed in euros, excluding tax. Billing terms (monthly, annual, usage-based) are specified contractually.
5. Term, renewal, and termination
Contract duration, renewal terms (automatic or not), and termination conditions (notice period, early termination for breach) are defined in the specific contract concluded with each Client.
6. Askuria's obligations
- Provide the Service in accordance with the contractual specifications;
- Ensure reasonable infrastructure availability, except for planned and communicated maintenance;
- Process data in accordance with our privacy policy and applicable regulation (GDPR);
- Notify the Client of any security breach affecting their data as soon as reasonably possible.
7. Client's obligations
- Use the Service in accordance with its intended purpose and applicable laws;
- Ensure the accuracy of information provided when enrolling protected identities;
- Not attempt to circumvent, alter, or compromise the Service's security mechanisms;
- Pay the agreed price according to the contractual schedule.
8. Intellectual property
Askuria retains all intellectual property rights in the Service, its code, trademarks, and documentation. The Client is granted a non-exclusive, non-transferable right of use, limited to the term of the contract and the agreed scope.
9. Liability
Askuria uses reasonable means to ensure the reliability of the Service. However, Askuria cannot be held liable for operational decisions made by the Client, nor for the consequences of the Client's misconfiguration of verification policies. Askuria's liability, if established, is limited to direct damages and capped under the terms specified in the specific contract.
10. Personal data protection
Processing of personal data under the Service is described in our privacy policy. Where required by GDPR, a data processing agreement ("DPA") is entered into separately with the Client.
11. Governing law and disputes
These Terms are governed by French law. Any dispute regarding their interpretation or performance shall, failing an amicable resolution, be submitted to the courts with jurisdiction over ASKURIA's registered office.
